Questions About Fires on Banks???

Is it legal to have a small fire on the banks if I am night fishing? I have fished at different spots where I have seen where there were fires before, ie burnt logs, ashes and whatnot. I was just curious as to if it was legal? Thank you.
What is not caught today will be starving tomorrow

Technically there are no open fires allowed although it is not strictly enforced.
